Regulators in Action: Strengthening Consumer Protection Together

With an array of financial products available in South Africa, knowing your consumer rights and where to seek recourse is paramount to protecting your household wealth.

Consumer rights and regulatory oversight took centre stage at the LeaderEx 2026 panel, “Regulators in action: Strengthening consumer protection together”. Moderated by Lelané Bezuidenhout, CFP®, CEO of the Financial Planning Institute of Southern Africa (FPI), the discussion brought together key leaders across the regulatory ecosystem:

Bonita Hughes – NFO
Timmy van der Grijp – NCR
Lyndwill Clark – FSCA
Adv John Simpson – FAIS Ombud

Navigating the South African Regulatory Landscape

Understanding which body holds authority over specific financial disputes allows consumers to resolve grievances quickly and efficiently.

National Financial Ombud (NFO)

Deals with consumer disputes regarding participating financial institutions, including general banking matters, credit disputes, and product issues. Services are completely free to the public.

Protocol: Raise your complaint directly with the financial institution first. If unresolved, escalate to the NFO.

Office of the FAIS Ombud

Investigates complaints against financial advisers and Financial Services Providers (FSPs). Covers instances where improper advice was provided or professional standards were breached.

Protocol: Submit details of the advice transaction, written communications, and the financial impact incurred.

National Credit Regulator (NCR)

Regulates the South African credit market. Oversees credit providers, credit bureaux, and debt counsellors to ensure fair credit practices.

Protocol: Verify that any debt counsellor or credit lender is active on the NCR official register before signing agreements.

Financial Sector Conduct Authority (FSCA)

Enforces market conduct rules across institutions, promotes fair treatment of customers, and drives national financial education initiatives to empower consumers.

Protocol: Use the FSCA search engine to verify licensing status and confirm FSP authorisation.

Combating Financial Scams: Stop, Think, and Verify

Digital scams—including online investment fraud, phishing, pyramid schemes, and fake trading opportunities—continue to threaten consumer security. The panel highlighted three fundamental steps to safeguard your funds:

  • Stop: Never yield to artificial urgency or pressure. High-quality financial opportunities never require instant decisions.
  • Think: Treat guarantees of abnormally high returns with near-zero risk as immediate red flags.
  • Verify: Independently check company registration on the official FSCA or NCR registers before transferring money.
