Stuck in the SARS System? The Power of the Tax Ombud
“When the root cause of a complaint is systemic, you don’t have to wait. The Office of the Tax Ombud (OTO) is your direct line to justice.”
What is a Systemic Issue?
In the world of South African tax, a systemic issue is a problem regarded as the underlying cause of a complaint that affects or will affect a large number of taxpayers. These aren’t simple “human errors”—they are breakdowns in SARS’s automated processes or legal adherence.
2026 Compliance Update
As of the February 2026 Budget Speech, personal income tax brackets have been fully adjusted for inflation for the first time in three years. However, with the total outstanding tax debt reaching approximately R646 billion, SARS has ramped up its automated “stoppers” and administrative penalties. This has led to a surge in cases where valid refunds are being held back due to debt equalisation delays.
When to Lodge a Complaint Directly with the OTO
Normally, you must exhaust SARS’s internal complaints mechanism. However, if your delay falls under these systemic categories, you can approach the OTO immediately:
The R70,886 Lesson
In a landmark case, a taxpayer was denied a R93,386 refund because of an outstanding R22,500 penalty from years prior. SARS failed to “equalise” the debt (paying the difference) and ignored the objection timeframes. The OTO intervened, forcing SARS to implement the equalisation and pay the remaining refund within days.
Is Your Refund “Ready” for Release?
According to the latest 2026 SARS guidelines, a refund should be paid within 72 hours, but ONLY if:
| Condition | Requirement |
|---|---|
| Debt Status | No money owed from prior years. |
| Filing Status | All past returns must be up to date. |
| Verification | No active audit or verification initiated. |
| Banking | SARS has verified your current bank details. |
Your Rights, Protected
In the 2021/22 year, the OTO secured over R215 million in top refunds alone. They continue to monitor profile hijacking and deceased estate coding issues to ensure SARS remains fair to all.
